His Excellency the Governor-General in Council
Pursuant to section 360(1)(a), (ha), (hb), (hf), and (hg) of the Resource Management Act 1991, His Excellency the Governor-General makes the following regulations, acting—
(a) on the advice and with the consent of the Executive Council; and
(b) on the recommendation of the Minister for the Environment made in accordance with section 360(2A) and (2B) of that Act.

Regulations
1 Title
These regulations are the Resource Management (Marine Pollution) Amendment Regulations 2011.
2 Commencement
These regulations come into force on 23 June 2011.
3 Principal regulations amended
These regulations amend the Resource Management (Marine Pollution) Regulations 1998.
4 New Schedule 1 substituted
Schedule 1 is revoked and the Schedule 1 set out in Schedule 1 of these regulations is substituted.
5 New Schedule 5 substituted
Schedule 5 is revoked and the Schedule 5 set out in Schedule 2 of these regulations is substituted.
6 Schedule 6 amended

(1) The Schedule 6 heading is amended by omitting
“r 3(1)”
and substituting“r 2”
.(2) Schedule 6 is amended by adding the clause set out in Schedule 3 of these regulations as clause 2.
7 Schedule 7 amended

(1) The Schedule 7 heading is amended by omitting
“r 3(1)”
and substituting“r 2”
.(2) The item relating to Raritan Engineering Company, Inc in the table in Schedule 7 is amended by—
(a) inserting the items set out in Part 1 of Schedule 4 of these regulations after the item relating to Lectra/San MC; and
(b) inserting the items set out in Part 2 of Schedule 4 of these regulations after the item relating to Purasan PST.

Noxious liquid substancesrr 2, 3(b)
1 Any substance that—
(a) is listed in the first column of a table referred to in clause 2; and
(b) is given a pollution category of X, Y, or Z in the relevant column of the table.
2 The tables are as follows:
(a) the table of substances in Chapter 17 or 18 of the International Code for the Construction and Equipment of Ships Carrying Dangerous Chemicals in Bulk in the form of those chapters set out in the Annex of the International Maritime Organization resolution MEPC.166(56) adopted on 13 July 2007 (see, for example, Annex 13 of the report of the Marine Environment Protection Committee on its fifty-sixth session dated 10 September 2007 (MEPC 56/23)):
(b) the table of substances in any of Annexes 1 to 4 of the International Maritime Organization circular dated 17 December 2010 about provisional categorization of liquid substances (MEPC.2/Circ.16).

Grade A sewage treatment systemsr 2
Any treatment system described in the first 5 columns of the table of treatment systems in Annex 5 of the International Maritime Organization circular dated 31 August 2005 about pollution prevention equipment required by MARPOL 73/78 (MEPC.5/Circ.9).

| 2 | Any system that meets or exceeds the standards in section 4 of the following guidelines, when tested under section 5 of the guidelines: the Revised Guidelines on Implementation of Effluent Standards and Performance Tests for Sewage Treatment Plants set out in the Annex of the International Maritime Organization resolution MEPC.159(55) adopted on 13 October 2006 (see, for example, Annex 26 of the report of the Marine Environment Protection Committee on its fifty-fifth session dated 16 October 2006 (MEPC 55/23)). |

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations amend the Resource Management (Marine Pollution) Regulations 1998 to update the lists of things referred to in the definitions of—
noxious liquid substance:
harmful substances:
Grade A treated sewage:
Grade B treated sewage.
These regulations come into force on 23 June 2011.
