Note
These regulations are administered in the Ministry of Social Development.
Pursuant to section 303 of the Education Act 1989, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
1 Title
-
(1) These regulations are the Student Allowances Amendment Regulations (No 2) 2003.
(2) In these regulations, the Student Allowances Regulations 19981 are called
“the principal regulations”
.
2 Commencement
These regulations come into force on the 28th day after the date of their notification in the Gazette.
3 Eligibility for basic grant
Regulation 7 of the principal regulations is amended by inserting, after subclause (1), the following subclause:

“(1A) As from the commencement of 1 January 2004, the students who are eligible for a basic grant include a single tertiary student of or over 16 but younger than 18 who—
“(a) has completed a course of secondary instruction to year 13 level; or
-
“(b) has not completed a course of secondary instruction to year 13 level but—
“(i) has obtained, in the University Bursaries Examination, 3

grade passes or better; or
“(ii) has obtained, at level 3 of the National Qualifications Framework, 42 credits or more.”

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend the Student Allowances Regulations 1998 (the principal regulations).
They provide that, as from the commencement of 1 January 2004, the students who are eligible to receive a basic grant under the principal regulations include a single tertiary student of or over 16 but younger than 18 who—
•has completed a course of secondary instruction to year 13 level; or
-
•has not completed a course of secondary instruction to year 13 level but—
•has obtained, in the University Bursaries Examination, 3
“C”
grade passes or better; or•has obtained, at level 3 of the National Qualifications Framework, 42 credits or more.
