Pursuant to section 9 of the Animal Products Act 1999, His Excellency the Administrator of the Government, on the recommendation of the Minister for Food Safety made in accordance with that section, and acting on the advice and with the consent of the Executive Council, makes the following order.
Order
1 Title
This order is the Animal Products (Exemptions and Inclusions) Amendment Order 2009.
2 Commencement
3 Principal order amended
This order amends the Animal Products (Exemptions and Inclusions) Order 2000.
4 Domestic dairy processors
(1)
The heading to clause 8A is amended by omitting “Domestic”
.
(2)
Clause 8A(2) is amended by omitting “this clause”
and substituting “subclause (1)”
.
(3)
Clause 8A is amended by adding the following subclauses:

A risk management programme is not required for dairy processors in relation to the transporting of dairy material or dairy product for export without official assurances or for the domestic market.
(4)
In subclause (3), transporting—
(a)
means transporting by vehicle or any other mode of transport; and
(b)
includes transferring dairy material or dairy product between vehicles or any other mode of transport used.
5 Processing of dairy material for animal consumption
(1)
The heading to clause 8B is amended by inserting “or dairy product”
after “dairy material”
.

Clause 8B(2) is amended by omitting “this clause”
and substituting “subclause (1)”
.

Clause 8B is amended by adding the following subclauses:

6 New clause 9A inserted
The following clause is inserted after clause 9:
9A Transporting of animal material or animal product for animal consumption
(1)
A risk management programme is not required for the transporting of animal material or animal product (other than dairy material or dairy product) for animal consumption for export without official assurances or for the domestic market.
(2)
In subclause (1), transporting—
(a)
means transporting by vehicle or any other mode of transport; and
(b)
includes transferring animal material or animal product between vehicles or any other mode of transport used.
7 Revocations
(1)
Clauses 8C and 8D are revoked.
(2)
The Animal Products (Exemptions and Inclusions) Amendment Order (No 2) 2008 (SR 2008/222) is consequently revoked.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order amends the Animal Products (Exemptions and Inclusions) Order 2000 and comes into force on 2 November 2009, except for the amendments in clauses 4 and 5, which come into force on 31 March 2010.
The amendments—
provide that a risk management programme is not required for dairy processors in relation to the transporting of dairy material or dairy product for export without official assurances or for the domestic market. This amendment comes into force on 31 March 2010:

revoke clauses 8C and 8D, which contain exemptions from the requirement to have a risk management programme in relation to the transporting and storage of certain products for export. These clauses expire on the close of 1 November 2009.

1 General
This is a consolidation of the Animal Products (Exemptions and Inclusions) Amendment Order 2009 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
