1 Title

This notice is the Fisheries (Declaration of New Stocks Subject to Quota Management System) Notice 2003.
2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.
3 References to quota management areas, species, and codes
-
(1) In Schedule 1,—
-
(a) the quota management areas referred to by a reference number are the fishery management areas described by reference to the same number in Part 1 of Schedule 1 of the Fisheries Act 1996, except as provided in paragraphs (c) to (d):
-
(b) where 2 or more quota management areas are shown as combined in respect of any stock, the combined areas together comprise 1 quota management area for that stock:
-
(c) in the case of certain giant spider crab (Jacquinotia edwardsii) stocks, the references to quota management areas 6A and 6B are references to the areas set out in Schedule 2:
-
(d) in the case of certain sea cucumber (Stichopus mollis) stocks, the references to quota management areas 1A, 1B, 2A, 2B, 5A, 5B, 7A, 7B, and 7D are references to the areas set out in Schedule 3.
(2) The references to species of fish in this notice are references to the species set out in the first column of Schedule 1.
(3) In Schedule 1—

(a) the references to fishstock codes are, in the case of stocks of horse mussel, sea cucumber, and surf clam, references to the existing reporting codes in Schedule 3 of the Fisheries (Reporting) Regulations 2001; and
-
(b) the fishstock codes for the other species are those set out in the second column of Schedule 1; and
-
(c) the references to QMS fishstock codes in the fourth column of Schedule 1 are references to the codes for the relevant stock once it is introduced to the quota management system.

4 New stocks to be subject to quota management system
-
The fishstocks specified in the second column of Schedule 1, in the quota management areas specified in the third column of that schedule, are subject to the quota management system established under Part 4 of the Fisheries Act 1996 on and from 1 April 2004.
5 Fishing years
-
The fishing year for each fishstock specified in Schedule 1 is the 12-month period beginning on 1 April.
6 How total allowable commercial catch and annual catch entitlements to be expressed
-
The total allowable commercial catch and annual catch entitlements for all fishstocks specified in Schedule 1 are to be expressed as greenweight kilograms.

All those areas of New Zealand fisheries waters within fisheries management area 6 enclosed within either of the following areas:

(a) an area enclosed by a line commencing at a point 49°30.0′S and 165°00.0′E, then—
-
(i) proceeding east along the 49°30.0′S line of latitude to longitude 168°00.0′E; then
-
(ii) proceeding south along the 168°00.0′E line of longitude to latitude 51°30.0′S; then
-
(iii) proceeding west along the 51°30.0′S line of latitude to longitude 165°00.0′E; then
-
(iv) proceeding north along the 165°00.0′E line of longitude to the point of commencement:

-
(b) an area enclosed by a line commencing at a point 51°30.0′S line of latitude to longitude 168°00.0′E, then—
-
(i) proceeding east along the 51°30.0′S line of latitude to longitude 171°00.0′E; then

All that area of New Zealand fisheries waters enclosed by a line—

(a) commencing on the mean high-water mark of the North Island at the north-easternmost point of Te Arai Point (approximately 36°09.5′S and 174°39.1′E); then

(b) proceeding in a generally northerly direction along the mean high-water mark of the North Island to the easternmost point of North Cape (approximately 34°24.8′S and 173°02.8′E); then
-
(c) proceeding north along this line of longitude from the easternmost point of North Cape to the exclusive economic zone boundary (approximately 30°53.1′S and 173°02.8′E); then
-
(d) proceeding in a generally south-easterly direction along the exclusive economic zone boundary to latitude 33°20.0′S off the north-east coast of the North Island (longitude approximately 177°51.0′E); then

Quota management area SCC1B—Hauraki Gulf and Bay of Plenty
All that area of New Zealand fisheries waters enclosed by a line—

(a) commencing on the mean high-water mark of the North Island at the north-easternmost point of Te Arai Point (approximately 36°09.5′S and 174°39.1′E); then
-
(b) proceeding in a generally south-easterly direction along the mean high-water mark of the North Island to the northernmost point of Cape Runaway (approximately 37°32.3′S and 177°59.0′E); then

(c) proceeding north along this line of longitude to the exclusive economic zone boundary (at approximately 33°27.7′S and 177°59.0′E); then
-
(d) proceeding in a generally north-westerly direction along the exclusive economic zone boundary to latitude 33°20.0′S off the north-east coast of the North Island (longitude approximately 177°51.0'E); then

Quota management area SCC2A—East Coast and Gisborne
All that area of New Zealand fisheries waters enclosed by a line—

(a) commencing on the mean high-water mark of the North Island at the northernmost point of Cape Runaway (approximately 37°32.3′S and 177°59.0′E); then

(b) proceeding north along this line of longitude to the exclusive economic zone boundary (at approximately 33°27.7′S and 177°59.0′E); then

(c) proceeding in a generally south-easterly direction along the exclusive economic zone boundary to the easternmost point of the exclusive economic zone boundary nearest 34°22.1′S and 179°29.6′E; then
-
(d) proceeding in a generally easterly direction directly to the westernmost point of the exclusive economic zone boundary nearest 34°34.2′S and 179°51.2′W; then
-
(e) proceeding in a generally south-easterly direction along the exclusive economic zone boundary to latitude 39°29.0′S (longitude approximately 177°35.0′W); then

(a) commencing on the mean high-water mark of the North Island adjacent to Bluff Hill, Napier (approximately 39°29′S and 176°55.3′E); then

(b) proceeding east along the 39°29′E line of latitude directly to the exclusive economic zone boundary (longitude approximately 177°35′W); then

(c) proceeding in a generally south-easterly direction along the exclusive economic zone boundary to latitude 42°10.0′S (longitude approximately 171°59.1′W); then

(d) proceeding west along the 42°10.0′S line of latitude to longitude 174°42.0′E; then

Quota management area SCC7A—Challenger (Marlborough Sounds)
All that area of New Zealand fisheries waters enclosed by a line—

(a) commencing at the northernmost point of Stephens Island (at approximately 40°39.0′S and 173°59.3′E); then

(b) proceeding north along this line of longitude to the northern boundary of fishery management area 7 (as defined in Schedule 1 of the Fisheries Act 1996 ) at approximately 40°16.0′S and 173°59.3′E; then

(c) proceeding in a generally south-easterly direction directly to a point at 40°32.0′S and 173°59.3′E; then

(d) proceeding in a generally southerly direction directly to the Brothers Island light (approximately 41°06.2′S and 174°26.5′E); then

(b) proceeding west along this line of latitude to the easternmost point of the exclusive economic zone boundary (at longitude approximately 167°04.2′E); then

(c) proceeding in a generally north-easterly direction along the exclusive economic zone boundary to the easternmost point of the exclusive economic zone boundary nearest 37°35.6′S and 170°05.7′E; then

(b) proceeding west along this line of latitude to the easternmost point of the exclusive economic zone boundary (at longitude approximately 167°04.2′E); then

(c) proceeding in a generally south-westerly direction along the exclusive economic zone boundary to a point on the latitude of the westernmost point of Awarua Point (approximately 44°15.6′S and 162°12.9′E); then

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice adds stocks from 12 species to the quota management system established under Part 4 of the Fisheries Act 1996 with effect on and from 1 April 2004.
The stocks concerned are certain species of giant spider crab, horse mussel, king crab, red crab, sea cucumber, and surf clam.

1 General

This is a reprint of the Fisheries (Declaration of New Stocks Subject to Quota Management System) Notice 2003. The reprint incorporates all the amendments to the notice as at 14 March 2003, as specified in the list of amendments at the end of these notes.
Relevant provisions of any amending enactments that contain transitional, savings, or application provisions are also included, after the principal enactment, in chronological order.
2 Status of reprints

Under section 16D of the Acts and Regulations Publication Act 1989, reprints are presumed to correctly state, as at the date of the reprint, the law enacted by the principal enactment and by the amendments to that enactment. This presumption applies even though editorial changes authorised by section 17C of the Acts and Regulations Publication Act 1989 have been made in the reprint.
This presumption may be rebutted by producing the official volumes of statutes or statutory regulations in which the principal enactment and its amendments are contained.
3 How reprints are prepared

A number of editorial conventions are followed in the preparation of reprints. For example, the enacting words are not included in Acts, and provisions that are repealed or revoked are omitted. 4 Changes made under section 17C of the Acts and Regulations Publication Act 1989

Section 17C of the Acts and Regulations Publication Act 1989 authorises the making of editorial changes in a reprint as set out in sections 17D and 17E of that Act so that, to the extent permitted, the format and style of the reprinted enactment is consistent with current legislative drafting practice. Changes that would alter the effect of the legislation are not permitted.
A new format of legislation was introduced on 1 January 2000. Changes to legislative drafting style have also been made since 1997, and are ongoing. To the extent permitted by section 17C of the Acts and Regulations Publication Act 1989, all legislation reprinted after 1 January 2000 is in the new format for legislation and reflects current drafting practice at the time of the reprint.
