Fisheries (Reporting Offences and Other Matters) Amendment Regulations (No 2) 2001

Note

These regulations are administered in the Ministry of Fisheries.

Pursuant to section 297(1)(h) of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title

(1) These regulations are the Fisheries (Reporting Offences and Other Matters) Amendment Regulations (No 2) 2001.

(2) In these regulations the Fisheries (Reporting) Regulations 2001¹ are called “the principal regulations”.

2 Commencement

These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Interpretation

(1) Regulation 3(1) of the principal regulations is amended by omitting from the definition of the term landing the word “means,”.

(2) Regulation 3(1) of the principal regulations is amended by inserting, before the words “in relation to” in paragraph (a) of the definition of the term landing, the word “means,”.

(3) Regulation 3(1) of the principal regulations is amended by adding, before the words “in relation to” in paragraph (b) of the definition of the term landing, the word “means,”.
(4) Regulation 3(1) of the principal regulations is amended by adding to the definition of the term landing the following paragraph:
- “(c) occurs from a vessel—
  
  “(i) when the vessel ceases to be registered or is re-registered under the Act, for whatever reason and by whatever mechanism; or
  
  “(ii) when fish are held on board the vessel at the close of a fishing year if the vessel is operated by, or on behalf of, a person who, during the fishing year ending on that day, has held 100 000 kilograms or more of annual catch entitlement under the Act”.

4 Offences

(1) Regulation 42(b) of the principal regulations is amended by omitting the words “8(2) or (3A)”, and substituting the words “8(2) or (4)”.

(2) Regulation 42(c) of the principal regulations is amended by omitting the expression “8(3B)”, and substituting the expression “8(5)”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after their notification in the Gazette, amend the Fisheries (Reporting) Regulations 2001 by—

•adding a new paragraph (c) to the definition of the term landing:
•correcting technical errors in the offences provision.
