These regulations are made under section 144 of the Human Rights Act 1993 on the advice and with the consent of the Executive Council.
Regulations
1 Title
These regulations are the Human Rights Review Tribunal Amendment Regulations 2019.
2 Commencement
These regulations come into force on 29 October 2019.
3 Principal regulations
These regulations amend the Human Rights Review Tribunal Regulations 2002 (the principal regulations).
4 Regulation 3 amended (Interpretation)
Revoke regulation 3(2).
5 Regulation 5 replaced (Commencement of proceedings)
Replace regulation 5 (as amended by section 340(3) and Part 3 of Schedule 8 of the Tribunals Powers and Procedures Legislation Act 2018) with:
5 Commencement of proceedings
(1)
A proceeding described in the first column of the table in regulation 6 is commenced by an application being filed by, or on behalf of, the person, persons, or body described in the second column of the table opposite the description of the proceeding.
(2)
An application must be—
(a)
made on an approved form; and
(b)
filed with the Ministry of Justice.
(3)
In this regulation, approved form means a form approved by the chief executive of the Ministry of Justice after consultation with the Chairperson of the Tribunal.
6 Regulation 6 amended (Person or body bringing proceedings)
In regulation 6, replace “regulation 5(3)”
with “regulation 5(1)”

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 29 October 2019, amend the Human Rights Review Tribunal Regulations 2002 (the principal regulations) to remove references to the appointment of 2 Chairpersons of the Human Rights Review Tribunal. Section 99 of the Human Rights Act 1993 (as replaced by section 81 of the Tribunals Powers and Procedures Legislation Act 2018) now provides for the appointment of only 1 Chairperson of the Tribunal by the Governor-General.
Regulation 5 of these regulations displaces the amendments made to regulation 5 of the principal regulations by the Tribunals Powers and Procedures Legislation Act 2018, which also come into force on 29 October 2019.
