These rules are made under section 16A of the Family Court Act 1980 on the advice and with the consent of the Executive Council.
Rules
1 Title
These rules are the Family Court Amendment Rules (No 2) 2024.
2 Commencement
These rules come into force on 3 October 2024.
3 Principal rules
These rules amend the Family Court Rules 2002.
4 Schedule 9 amended
(1)
In Schedule 9, form PPPR 5, paragraph 3, replace “$5,000”
with “$25,000”
.
(2)
In Schedule 9, form PPPR 5, paragraph 4, replace “$20,000 in any 1 year”
with “, in any 1 year, the amount prescribed for the purposes of section 11(2)(b) of the Protection of Personal and Property Rights Act 1988”
.

Explanatory note
This note is not part of the rules but is intended to indicate their general effect.
These rules, which come into force on 3 October 2024, amend Schedule 9 of the Family Court Rules 2002 (the principal rules). Schedule 9 of the principal rules sets out forms to be used in proceedings in the Family Court under the Protection of Personal and Property Rights Act 1988 (the Act).
Forms PPPR 5 (application for order to administer property of applicant) and PPPR 6 (application for order to administer property) in Schedule 9 of the principal rules refer to the monetary thresholds in section 11(2) of the Act. Those references are amended to reflect the changes to the monetary thresholds in section 11(2) of the Act being made by the Protection of Personal and Property Rights Order 2024 that is to come into force at the same time as these rules.
