This order is administered in the Ministry of Fisheries.
Pursuant to sections 14, 67B, and 72(7) of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title
This order is the Fisheries (Schedules 3, 5A, and 6) Order 2004.
2 Commencement
This order comes into force on 1 October 2004.
3 New items inserted in Schedule 3 of Fisheries Act 1996
Schedule 3 of the Fisheries Act 1996 is amended by inserting, in their appropriate alphabetical order, the items set out in Schedule 1.
4 New item inserted in Schedule 5A of Fisheries Act 1996
Schedule 5A of the Fisheries Act 1996 is amended by inserting, after the item
“PAU10”

5 New items inserted in Schedule 6 of Fisheries Act 1996
Schedule 6 of the Fisheries Act 1996 is amended by inserting, in their appropriate alphabetical order, the items set out in Schedule 2.

| (a) that swordfish is likely to survive on return; and | ||
| (b) the return takes place as soon as practicable after the swordfish is taken; and | ||
| (c) that swordfish has a lower jaw to fork length of less than 1.25 m. | ||
For the purposes of this requirement, “lower jaw to fork length”means the projected straight line distance from the foremost point of the lower jaw to the rear centre edge of the tail (caudal fin). |

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which takes effect on 1 October 2004, adds—
•bigeye tuna, blue shark, green-lipped mussel, long-finned freshwater eel, mako shark, moonfish, Pacific bluefin tuna, porbeagle shark, ray's bream, short-finned freshwater eel, southern bluefin tuna, swordfish, and yellowfin tuna to Schedule 3 of the Fisheries Act 1996 (which lists stocks that are managed with an alternative total allowable catch):
•pipi in Whangarei Harbour to Schedule 5A of the Fisheries Act 1996 (which lists stocks for which no additional annual catch entitlement may be allocated where underfishing occurs):
•blue shark, green-lipped mussel, mako shark, pipi, porbeagle shark, spiny dogfish, southern bluefin tuna, and swordfish to Schedule 6 of the Fisheries Act 1996 (which lists stocks that may be returned to the sea or other waters in accordance with stated requirements).
