These regulations are made under section 74 of the Te Arawa Lakes Settlement Act 2006 on the advice and with the consent of the Executive Council.

Regulations
1 Title
These regulations are the Te Arawa Lakes (Fisheries) Amendment Regulations 2023.
2 Commencement
These regulations come into force on 6 October 2023.
3 Principal regulations
These regulations amend the Te Arawa Lakes (Fisheries) Regulations 2006.
4 Regulation 15 amended (Purpose and scope of puka whakamana)
In regulation 15(3), replace “not exceeding 48 hours from the commencement of the puka whakamana”
with “specified in the puka whakamana”
.
5 Regulation 17 amended (Determination of request for puka whakamana)
After regulation 17(2)(b)(vi), insert:
(via)
reporting requirements that support the management objectives of the mahire whakahaere; and
6 Regulation 18 amended (Form and contents of puka whakamana)
(1)
In regulation 18(1)(a) and (b), after “writing”
, insert “or by or in any electronic medium”
.
(2)
In regulation 18(3), replace “In every case”
with “If a puka whakamana is issued in writing or orally,”
.
(3)
After regulation 18(4), insert:
(4A)
If a puka whakamana is issued by or in any electronic medium, the poutiriao must—
(a)
note on the puka whakamana that it is issued electonically; and
(b)
retain an electronic copy, as required for the purpose of regulation 22(1); and
(c)
provide an electronic copy of the puka whakamana to the person authorised.
(4)
Revoke regulation 18(6).
7 Regulation 19 amended (Production of puka whakamana to fishery officer)
After regulation 19(a), insert:
(aa)
in the case of a puka whakamana issued by or in any electronic medium, if requested by a fishery officer,—
(i)
provide an electronic copy of the puka whakamana to the officer; or
(ii)
advise the officer orally of the number and other particulars of the puka whakamana issued to that person; or
8 Regulation 20 amended (Reporting on customary food gathering)
In regulation 20(1)(b) and (2), after “issued”
, insert “by or in any electronic medium or”

9 Schedule amended
In the Schedule, form 2, under the heading “Report on catch by person authorised”
, after “Date signed:”
, revoke the note.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 6 October 2023, amend the Te Arawa Lakes (Fisheries) Regulations 2006. The amendments—
provide for a puka whakamana to be issued for any period specified in the puka whakamana:
provide for a puka whakamana to be issued by or in any electronic medium:
provide for a poutiriao to impose reporting requirements that support the management objectives of the mahire whakahaere.
