This notice is administered by the Ministry of Health.
Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

1 Title
This notice is the Health Practitioners (Quality Assurance Activity—Royston Hospital) Notice 2011.
2 Commencement
This notice comes into force on the day after the date of its notification in the Gazette.
3 Declaration of protected quality assurance activity
The Royston Hospital Quality Assurance Activity described in the Schedule is a protected quality assurance activity.
4 Revocation
The Health Practitioners (Quality Assurance Activity—Royston Hospital) Notice 2006 (SR 2006/367) is revoked.
Schedule Description of Royston Hospital Quality Assurance Activity
1 Interpretation
In this schedule,—
activity means the Royston Hospital Quality Assurance Activity described in clause 4
participant means a health practitioner who—
(a)
provides health services at Royston Hospital on behalf of Wakefield Health Limited; and
(b)
is participating in the activity.
2 Objective
The objective of the activity is to improve the practices and competence of participants by assessing the health services performed by those participants.
3 Information
The activity is based on information derived from participants.
4 Activity
The activity involves—
(a)
examining patients’ records; and
(b)
analysing the following data on patients:
(i)
admission, discharge (including by transfer), and readmission; and
(ii)
morbidity; and
(iii)
mortality; and
(iv)
outcomes of treatment; and
(c)
identifying and analysing adverse outcomes, complications, or problems that arise in the treatment of patients and that are disclosed by the actions taken under paragraphs (a) and (b); and
(d)
considering reports prepared by participants on adverse outcomes, complications, or problems that arise in the treatment of patients; and
(e)
holding audit and peer review meetings to study and discuss the results obtained under paragraphs (c) and (d), and providing information for the purposes of those meetings; and
(f)
compiling information obtained from the actions taken under paragraphs (a) to (e) and reporting that information to medical advisory and other hospital committees; and
(g)
reporting back to participants on the results of the actions referred to in paragraphs (a) to (f) (for example, on trends showing up in the information referred to in paragraph (f), and on any changes in practice that are desirable to respond to those trends); and
(h)
making recommendations on how participants can improve their performance so as to—
(i)
improve the quality of care they provide; and
(ii)
reduce the incidence of adverse outcomes, complications, or problems; and
(i)
facilitating and monitoring implementation of any recommendations referred to in paragraph (h).

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice, which comes into force on the day after the date of its notification in the Gazette, declares the Royston Hospital Quality Assurance Activity to be a protected quality assurance activity. The effect of this declaration is that—
any information that becomes known solely as a result of the activity is confidential; and
any documents brought into existence solely for the purposes of the activity are confidential; and
the persons who engage in the activity in good faith are immune from civil liability.
The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.
Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
This notice revokes and replaces the Health Practitioners (Quality Assurance Activity— Royston Hospital) Notice 2006.
