Her Excellency the Administrator of the Government in Council
Pursuant to section 51C of the Judicature Act 1908, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council, and with the concurrence of the Right Honourable the Chief Justice and at least 2 other members of the Rules Committee (of whom at least 1 was a Judge of the High Court), makes the following rules.

Rules
1 Title
These rules are the High Court (Lawyers and Conveyancers Act 2006) Amendment Rules 2008.
2 Commencement
These rules come into force on 1 August 2008.
3 Principal rules amended
These rules amend the High Court Rules set out in Schedule 2 of the Judicature Act 1908.
4 Authority to file documents
Rule 41(b) is amended by omitting
“solicitor or as a barrister and solicitor issued under section 56 of the Law Practitioners Act 1982”
and substituting“barrister and solicitor issued under section 39 of the Lawyers and Conveyancers Act 2006”
.
5 Search of rolls of barristers and solicitors
Rule 67 is amended by omitting
“section 49 of the Law Practitioners Act 1982”
and substituting“section 56 of the Lawyers and Conveyancers Act 2006”
.
6 Application of Part 4A
-
(1) Rule 458D(1)(a) is amended by revoking subparagraph (xiii) and substituting the following subparagraph:
“(xiii) section 149 of the Law Practitioners Act 1982 (as continued by section 361(5) of the Lawyers and Conveyancers Act 2006):”.
(2) Rule 458D(1)(a) is amended by inserting the following subparagraph after subparagraph (xiv):
“(xv) sections 30, 37, and 52 of the Lawyers and Conveyancers Act 2006:”.

Explanatory note
This note is not part of the rules, but is intended to indicate their general effect.
These rules, which come into force on 1 August 2008, make consequential changes to the High Court Rules that are required by the coming into force of the Lawyers and Conveyancers Act 2006 on that date.
