These regulations are made under section 636 of the Education and Training Act 2020 on the advice and with the consent of the Executive Council.

Regulations
1 Title
These regulations are the Education (Early Childhood Services) Amendment Regulations (No 2) 2024.
2 Commencement
These regulations come into force on 1 January 2025.
3 Principal regulations
These regulations amend the Education (Early Childhood Services) Regulations 2008.
4 Regulation 28 amended (Additional requirements for licensed home-based education and care service)
Replace regulation 28(1)(e) with:
(e)
for each of the service provider’s licences, maintain a list of educators engaged by the service provider, and evidence of each educator’s—
(i)
home-based service qualification(s); and
(ii)
enrolment in a course or courses offering a home-based service qualification.
5 Regulation 44 amended (Qualifications, ratios, and service-size standard: general)
Revoke regulation 44(3A).
6 Regulation 62 amended (Additional duties of person responsible for licensed home-based education and care service)
Replace regulation 62(2) with:
(2)
A person responsible for a licensed home-based education and care service must not act as a person responsible for more than 1 licensed early childhood service at the same time.
7 Schedule 1A amended
(1)
In Schedule 1A, revoke—
(a)
the second item relating to 1 June 2022; and
(b)
the item relating to 1 January 2023; and
(c)
the item relating to 1 January 2024; and
(d)
the first item relating to 1 January 2025.
(2)
In Schedule 1A, replace the second item relating to 1 January 2025 with:
| Starting on 1 January 2025 | Educators who are already working at a licensed home-based education and care service must— (a)hold a home-based service qualification; or (b)by 1 July 2025, enrol in a course offering a home-based service qualification and complete the qualification— (i)within 4 years of enrolment, if the qualification is an early childhood teaching qualification at level 7 or above on the Qualifications Framework; or (ii)within 2 years of enrolment, for any other qualification |

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which come into force on 1 January 2025, amend the Education (Early Childhood Services) Regulations 2008 (the principal regulations).
The principal regulations require, for a licensed home-based education and care service (a service), that—
80% of persons providing education and care to children as part of the service (educators) hold particular qualifications (home-based service qualifications); and
the remaining 20% enrol in a course offering a home-based service qualification (within 6 months of joining the service) and complete the qualification within specified times.
These regulations amend regulation 44 and Schedule 1A to require all educators to—
have a home-based service qualification; or
enrol in a course offering a home-based service qualification within 6 months of a joining a service (educators already working in a service must enrol in a course by 1 July 2025) and complete the qualification within specified times.
These regulations also—
amend regulation 28 to require a service provider who operates a service to also maintain records of evidence of enrolment of educators in a course or courses offering a home-based service qualification; and
amend regulation 62 to remove the restriction that a person who has primary responsibility for overseeing the education, and health and safety of the children for a service (the person responsible) must not act as a person responsible for more than 2 licensed early childhood services in any month.
