Pursuant to section 297(1) of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations
1 Title
These regulations are the Fisheries (Auckland and Kermadec Areas Commercial Fishing) Amendment Regulations 2008.
2 Commencement
These regulations come into force on 1 April 2008.
3 Principal regulations amended
These regulations amend the Fisheries (Auckland and Kermadec Areas Commercial Fishing) Regulations 1986.
4 Taking of cockle prohibited in certain areas
Regulation 4C(2) is amended by omitting paragraph (a) and substituting the following paragraph:
“(a) the area known as Snake Bank lying within Whangarei Harbour, being the area enclosed by a straight line commencing at One Tree Point (at 35°49.15′S and 174°27.28′E) to Reserve Point (at 35°47.69′S and 174°27.65′E) then along a straight line to Darch Point (at 35°49.17′S and 174°29.60′E) then along the mean high water mark to Lort Point (at 35°49.87′S and 174°30.15′E) then along a straight line to the point of commencement at One Tree Point:”.
5 Regulation 14 revoked
Regulation 14 is revoked.
6 New regulation 21 substituted
Regulation 21 is revoked and the following regulation substituted:
“21 Taking of rock lobster prohibited near North Cape light
No commercial fisher shall take any rock lobster from those waters lying to the north-east of the North Island bounded by a line commencing at the North Cape light (at 34°24.90′S and 173°03.00′E) and proceeding northerly along the 173°03.00′ East meridian of longitude to its intersection with the 34°20.00′ South parallel of latitude; then easterly along that parallel of latitude to its intersection with the 173°09.00′ East meridian of longitude; then southerly along that meridian of longitude to its intersection with the 34°28.00′ South parallel of latitude, then westerly to its intersection with the 173°03.00′ East meridian of longitude; then northerly along that meridian of longitude to the point of commencement at the North Cape light.”

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations come into force on 1 April 2008.
These regulations amend the Fisheries (Auckland and Kermadec Areas Commercial Fishing) Regulations 1986 as follows:
regulation 4C, to specify the correct area where commercial fishing for cockle is allowed within the Whangarei Harbour:
regulation 14 is revoked to remove the exemption for the Kaipara Harbour from the general prohibition under regulation 61 of the Fisheries (Commercial Fishing) Regulations 2001 against nets being set so that stalling occurs:
regulation 21, to correct certain co-ordinates defining the area in the vicinity of the North Cape light where the taking of rock lobster is prohibited.
