These regulations are made under section 43F of the Gas Act 1992 on the advice and with the consent of the Executive Council and on the recommendation of the Minister for Energy made in accordance with sections 43I to 43P of that Act.
Regulations
1 Title
These regulations are the Gas Governance (Critical Contingency Management) Amendment Regulations 2024.
2 Commencement
These regulations come into force on 8 March 2024.
3 Principal regulations
These regulations amend the Gas Governance (Critical Contingency Management) Regulations 2008.
4 Schedule 1 amended
In Schedule 1, in the table,—
(a)
revoke the item with the point of measurement “Taupo TAU07001”
:

replace “Whakatane”
with “Whakatāne”

(c)
replace “Whangarei”
with “Whangārei”

(d)
in the last item, replace the text in the first column with:
For any other gas gate on the Maui or Vector pipeline, excluding Taupō TAU07001 and Broadlands BRO36301

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations come into force on 8 March 2024. They amend Schedule 1 of the Gas Governance (Critical Contingency Management) Regulations 2008 (the principal regulations), which prescribes thresholds relating to the operating pressure at various points on the Maui and Vector gas pipelines.
The regulations remove the gas gates at Taupō and Broadlands from Schedule 1 of the principal regulations. The amendment means the critical contingency management plan required to be maintained by the transmission system owner under Part 2 of the principal regulations no longer has to provide for thresholds in relation to the parts of the Vector pipeline measured at the Taupō and Broadlands gas gates. Consequently the transmission system owner can lower the operating pressure in those parts of the pipeline without breaching the critical contingency management plan and causing a critical contingency, which would require the critical contingency operator to make a declaration under regulation 49 of the principal regulations.
The regulations also update some place names to align with their official spelling.
