Pursuant to sections 163 and 164 of the Climate Change Response Act 2002, His Excellency the Administrator of the Government makes the following regulations, acting—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister for Climate Change Issues made after complying with the requirements in sections 163(5) and 166(1) of that Act.
Regulations
1 Title
These regulations are the Climate Change (Unique Emissions Factors) Amendment Regulations 2015.
2 Commencement
These regulations come into force on 1 January 2016.
3 Application
These regulations apply for the year commencing on 1 January 2016 and for each subsequent year.
4 Principal regulations
These regulations amend the Climate Change (Unique Emissions Factors) Regulations 2009 (the principal regulations).
5 Regulation 23C amended (Requirements relating to application for unique emissions factor approval in relation to LFG collection and destruction system)

In regulation 23C(1)(g), replace “UEF = 1.31 × (1 – C)”
with “UEF = 1.19 × (1 – C)”

Replace regulation 23C(2)(b)(ii)(B) with:
(B)
base tonnage for the year either on the average filling rate over the life of the disposal facility up to the first year in which the weighbridge data is available or on other data for the year that the EPA is satisfied enables a reasonably reliable estimate of tonnage; and
6 Schedule 3 amended
In Schedule 3, replace the second column with the column set out in the Schedule of these regulations.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations amend the Climate Change (Unique Emissions Factors) Regulations 2009 (the principal regulations) to—
align regulation 23C and Schedule 3 with the default emissions factor in the Climate Change (Waste) Regulations 2010 (as amended by the Climate Change (Waste) Amendment Regulations 2015); and
provide that, when calculating landfill methane gas emissions, historical annual landfill input tonnage data may be used, rather than average filling rate, if that data is available and the Environmental Protection Authority is satisfied it is reliable.
These regulations come into force on 1 January 2016 and apply for the year commencing on that date and for each subsequent year.
