Pursuant to section 2 of the Land Transport Act 1998, the Minister of Police gives the following notice.

1 Title
This notice is the Land Transport (Breath Tests) Amendment Notice 2011.
2 Principal notice amended
This notice amends the Land Transport (Breath Tests) Notice 2009.
3 Commencement
This notice comes into force on 7 August 2011.
4 Manner of carrying out breath screening tests by means of Dräger 6510
Clause 6 is amended by revoking paragraph (c) and substituting the following paragraph:

“(c) Step 3: Results of test
“(i) If the display panel shows Pass, the result indicates that the test is negative. As a confirmation, the indicator light will be a steady green for a short time (approximately 20 seconds or such shorter time as the officer may permit).
“(ii) If the display panel shows Under 250, the result indicates that the person's breath contains alcohol but the proportion of alcohol in the person's breath does not exceed 249 micrograms of alcohol per litre of breath. As a confirmation, the indicator light will be a steady amber for a short time (approximately 20 seconds or such shorter time as the officer may permit).
“(iii) If the display panel shows 250+Over, the result indicates that the proportion of alcohol in the person's breath equals or exceeds 250 micrograms of alcohol per litre of breath but does not exceed 400 micrograms of alcohol per litre of breath. As a confirmation, the indicator light will flash red and amber alternately for a short time (approximately 20 seconds or such shorter time as the officer may permit).
“(iv) If the display panel shows Over 400, the result indicates that the proportion of alcohol in the person's breath exceeds 400 micrograms of alcohol per litre of breath. As a confirmation, the indicator light will be a steady red for a short time (approximately 20 seconds or such shorter time as the officer may permit).”

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice, which comes into force on 7 August 2011, amends the Land Transport (Breath Tests) Notice 2009 to provide new specifications on how breath screening test results will be displayed on the Dräger 6510 breath screening device.
New display specifications are provided because of amendments made to the Land Transport Act 1998 by section 91 of the Land Transport (Road Safety and Other Matters) Amendment Act 2011.
