Pursuant to section 114 of the Legal Services Act 2011, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
Regulations
1 Title
These regulations are the Legal Services (Quality Assurance) Amendment Regulations 2011.
2 Commencement
These regulations come into force on the 28th day after the date of their notification in the Gazette.
3 Principal regulations amended
These regulations amend the Legal Services (Quality Assurance) Regulations 2011.
4 Experience and competence requirements

(1) Regulation 6(1) is amended by omitting
“and category of proceedings (if any)”
.(2) Regulation 6(2)(c) is amended by omitting
“or category of proceedings”
and substituting“of law”
.(3) Regulation 6(3) is amended by omitting
“or category of proceedings”
.(4) Regulation 6(4) is amended by omitting
“or category of proceedings”
.
5 References
Regulation 8(3) is amended by omitting
“or category of proceedings”
.
6 Conditions on approval
Regulation 10(1)(d) is amended by omitting
“or category of proceedings”
.
7 Schedule amended
Clause 1 of the Schedule is amended by revoking subclause (2) and substituting the following subclause:
“(2) An applicant who has the experience and competence required for a particular category of criminal proceedings has the experience and competence required for any category of criminal proceedings below that category.”

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which amend the Legal Services (Quality Assurance) Regulations 2011 (the principal regulations), come into force on the 28th day after the date of their notification in the Gazette.
These regulations correct the principal regulations by removing the words category of proceedings from provisions that refer to an applicant's experience and competence in an area of law or category of proceedings.
These regulations also clarify that an applicant who has the experience and competence to provide legal services or specified legal services for a particular category of criminal proceedings has the experience and competence to provide those services for any lower category of criminal proceedings.
