Pursuant to section 69 of the National Animal Identification and Tracing Act 2012, His Excellency the Governor-General makes the following regulations, acting—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister made in accordance with that section.
Regulations
1 Title
These regulations are the National Animal Identification and Tracing (Obligations and Exemptions) Amendment Regulations 2015.
2 Commencement
These regulations come into force on 1 July 2015.
3 Principal regulations
These regulations amend the National Animal Identification and Tracing (Obligations and Exemptions) Regulations 2012 (the principal regulations).
4 Regulation 17 amended (Impracticable to fit device)
After regulation 17(2), insert:
(2A)
It is a condition of the exemption that, during the period of the exemption, an owner of the animal pay any levy set under the Act on the owner of a NAIT animal that is not fitted with a NAIT device.
5 Regulation 27 amended (Offences and penalties)
In regulation 27(1), replace “17(4)”
with “17(2A), (4)”

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations amend the National Animal Identification and Tracing (Obligations and Exemptions) Regulations 2012 (the principal regulations). The amendments come into force on 1 July 2015.
The amendments relate to a PICA (person in day-to-day charge of an animal) who, under regulation 17(2) of the principal regulations, is exempt from certain obligations about an animal because the PICA has decided that it is impracticable to fit a NAIT device to the animal. The amendments impose another condition on the exemption so that an owner of the animal must pay any levy set for such animals under the National Animal Identification and Tracing Act 2012. The offence provision is amended so that it continues to apply to all conditions of exemption.
