Pursuant to section 2(1) of the New Zealand Railways Corporation Restructuring Act 1990, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.
Order
1 Title
This order is the Railway Operator Amendment Order 2012.
2 Commencement
This order comes into force on 31 December 2012.
3 Principal order
This order amends the Railway Operator Order 1990 (the principal order).
4 Clause 2 replaced (New Zealand Rail Limited declared to be railway operator)
Replace clause 2 with:
“2 Railway operators
Each of the following is declared to be a railway operator for the purposes of the New Zealand Railways Corporation Restructuring Act 1990:
“(a) KiwiRail Limited:
“(b) KiwiRail Holdings Limited.”

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on 31 December 2012, amends the Railway Operator Order 1990 (the principal order). The principal order declares New Zealand Rail Limited to be a railway operator for the purposes of the New Zealand Railways Corporation Restructuring Act 1990. New Zealand Rail Limited's name is now KiwiRail Limited. This order amends the principal order to reflect that change and to declare KiwiRail Holdings Limited to be a railway operator.
