Supreme Court (Criminal Fees) Amendment Regulations 2013

Pursuant to section 387 of the Criminal Procedure Act 2011, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
Regulations
1 Title
These regulations are the Supreme Court (Criminal Fees) Amendment Regulations 2013.
2 Commencement
These regulations come into force on 4 October 2013.
3 Principal regulations
These rules amend the Supreme Court (Criminal Fees) Regulations 2013 (the principal regulations).
4 Regulation 3 amended (Interpretation)
In regulation 3, delete the definition of access.
5 Regulation 4 amended (Access fees)

(1) Replace regulation 4(2) and (3) with:

“(2) Each of the following is entitled to one copy of any part or parts of the court file or any document relating to a criminal appeal without paying the fee prescribed by item 2 or 3 of the Schedule:
“(a) a party to the appeal:
“(b) a lawyer representing a party to the appeal:
“(c) if the defendant in the proceeding to which the appeal relates is a corporation, a representative of the defendant appointed in accordance with section 12 of the Act.”
(2) In regulation 4(4), delete
“or (3)”

6 Schedule amended
In the Schedule, revoke item 1.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 4 October 2013, amend the Supreme Court (Criminal Fees) Regulations 2013 by—
revoking the fee prescribed for requesting access to the formal court record, the court file, or one or more documents, relating to a criminal appeal in the Supreme Court; and
consequentially amending elements of regulation 4 providing that certain people do not have to pay some of the prescribed fees.
