Pursuant to section 167 of the Land Transport Act 1998, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations
1 Title
These regulations are the Land Transport (Offences and Penalties) Amendment Regulations (No 2) 2013.
2 Commencement
These regulations come into force on 1 November 2013.
3 Principal regulations
These regulations amend the Land Transport (Offences and Penalties) Regulations 1999 (the principal regulations).
4 Schedule 1 amended

(1) In Schedule 1, under the heading
“Land Transport (Road User) Rule 2004 (61001)”
, in the item relating to clause 7.6, replace“under 5”
with“under 7”
.(2) In Schedule 1, under the heading
“Land Transport (Road User) Rule 2004 (61001)”
, in the item relating to clause 7.7, replace“5–7”
with“7”

5 Schedules 4 and 5 amended
In Schedules 4 and 5, replace
“section 94”
with“section 98”

6 Schedule 4A amended

(1) In Schedule 4A, Part 1, under the heading
“Advice to driver”
, replace paragraph (b) with:“(b) your driver licence was for the time being suspended because you were subject to a driver licence stop order.
“(ba) your driver licence was for the time being suspended for any other reason, or was revoked.”
(2) In Schedule 4A, Part 2, replace
“section 94”
with“section 98”
in each place.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 November 2013, amend the Land Transport (Offences and Penalties) Regulations 1999 (the principal regulations).
The regulations amend—
Schedule 1 of the principal regulations to reflect changes made by the Land Transport (Road User) Amendment Rule (No 2) 2013 to the rules governing the use of child restraints; and
Schedule 4A of the principal regulations to include on a vehicle seizure and impoundment notice, as a reason for seizing and impounding a vehicle, driving while subject to a driver licence stop order; and
Schedules 4, 4A, and 5 of the principal regulations to replace references to section 94 of the Summary Proceedings Act 1957 with references to section 98 of that Act.
