Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations amend the Climate Change (Stationary Energy and Industrial Processes) Regulations 2009 (the principal regulations). The regulations—
correct the figure J (the global warming potential for CF4) in the formula for calculating emissions from producing aluminium set out in regulation 35(1) of the principal regulations:
amend the default emission factors for geothermal fluid prescribed in table 6 in Schedule 2 of the principal regulations to take account of changes in geothermal fluid emissions:
add the Nga Awa Purua geothermal field to table 6 in Schedule 2 of the principal regulations:
amend the default emission factors for classes of mined or purchased natural gas prescribed in table 10 in Schedule 2 of the principal regulations to take account of changes in gas emissions:
add the Kowhai and Maari gas fields to table 10 in Schedule 2 of the principal regulations.
The regulations come into force on 4 March 2015, but apply from 31 December 2014 because section 166(3) of the Climate Change Response Act 2002 provides that regulations made under section 163 of that Act may come into force no earlier than 3 months after the date of their notification in the Gazette, while section 163(3) of that Act allows the regulations to apply in respect of a period after any particular date within the year in which they are made.
Issued under the authority of the Legislation Act 2012.
Date of notification in Gazette: 4 December 2014.
These regulations are administered by the Ministry for the Environment.
