Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 April 2017, amend the Veterans’ Support Regulations 2014 (the principal regulations).
Regulation 42 of the principal regulations prescribes the rates of veteran’s pension payable under Part 6 of the Veterans’ Support Act 2014 (the Act). Section 170 of the Act provides for the rates of veteran’s pension to be reviewed before 1 April every year and, if the review concludes that any of the rates require adjustment under that section, to be adjusted as at 1 April. Regulation 4 amends regulation 42 of the principal regulations to adjust the rates of veteran’s pension payable in accordance with section 170 of the Act.
Regulations 5, 6, and 7 relate to certain entitlements under the War Pensions Act 1954 that have continued to be paid under Part 1 of Schedule 1 of the Veterans’ Support Act 2014. There are 2 main changes in relation to these entitlements, as follows:
references to 2 of the 3 entitlements are removed from the principal regulations because they are longer relevant. The 2 entitlements are—
a travelling allowance. The travel costs of relevant veterans are now met in appropriate cases in accordance with subpart 4 of Part 5 of the Act; and
an annuity for recipients of the Victoria Cross (United Kingdom). The Victoria Cross (United Kingdom) was superseded in New Zealand by the Victoria Cross for New Zealand in 1999 and there are no longer any living veterans who hold the Victoria Cross (United Kingdom):
the amount of the remaining entitlement, payable to recipients of certain awards relating to gallantry, is adjusted. The adjustment increases the amount of the entitlement by 1.10%, which reflects the increase in the New Zealand Consumers Price Index (All Groups), excluding cigarettes and other tobacco products, between the December 2015 quarter and the December 2016 quarter.
Regulation 8(1) revokes 8 sets of amendment regulations that were made in 2015 and 2016. The amendment regulations no longer serve any purpose.
These regulations are revoked on the close of 1 May 2017.
Issued under the authority of the Legislation Act 2012.
Date of notification in Gazette: 2 March 2017.
