These regulations are made under section 424 of the Social Security Act 2018 on the advice and with the consent of the Executive Council.
Regulations
1 Title
These regulations are the Social Security (Childcare Assistance—Cohort Entry Policy) Amendment Regulations 2019.
2 Commencement
These regulations come into force on 1 January 2020.
3 Principal regulations
These regulations amend the Social Security Regulations 2018 (the principal regulations).
4 Regulation 30 amended (Eligibility of child for payment of childcare subsidy)
(1)
In regulation 30(1)(b), replace “not be enrolled in that school until the term start date of the next term” with “be enrolled in that school not earlier than the child’s fifth birthday on a date that is a term start date or a mid-term start date”.

Replace regulation 30(2) with:

Eligibility under subclause (1)(b) ends on the first term start date or mid-term start date to occur on or after the child’s fifth birthday.
(3)
In this regulation, mid-term start date and term start date have the meanings given in section 5B of the Education Act 1989.
5 Regulation 38 amended (Eligibility of child for payment of OSCAR subsidy)
Revoke regulation 38(c)(ii).

Eligibility for payment of OSCAR subsidy of child who is at least 4 years old, and enrolled in and attending school that has cohort entry policy in place
2 Effect of revocation of regulation 38(c)(ii)
The revocation of regulation 38(c)(ii) on 1 January 2020 does not affect a child’s eligibility for payment of an OSCAR subsidy under that regulation as in force before that date.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 January 2020, amend the Social Security Regulations 2018. The amendments—
adjust the eligibility criteria for a childcare subsidy in respect of children who are 5 and yet to be enrolled in a school with a cohort entry policy in place; and
revoke the provision for an OSCAR subsidy in respect of children who are at least 4 and enrolled in and attending a school with a cohort entry policy in place.
