Order

1 Title

This order is the Climate Change (General Exemptions) Amendment Order (No 2) 2019.

2 Commencement

This order comes into force on 19 December 2019.

3 Principal order

This order amends the Climate Change (General Exemptions) Order 2009 (the principal order).

4 New clause 13A inserted (Exemption for operating disposal facility in relation to certain waste)

After clause 13, insert:

13A Exemption for operating disposal facility in relation to certain waste

A person who carries out the activity of operating a disposal facility is exempt as a participant in respect of the part of the activity involving the disposal of waste that—

(a)

had previously been disposed of at the Fox Glacier landfill; and

(b)

is disposed of by the disposal facility on or after 1 April 2019.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 19 December 2019, amends the Climate Change (General Exemptions) Order 2009 (the principal order).

This order amends the principal order to exempt persons who operate disposal facilities from being participants under the Climate Change Response Act 2002. A person who operates a disposal facility is exempt in relation to waste disposed of by the facility from 1 April 2019 that was previously disposed of at the Fox Glacier landfill.
