This order is made by the Minister for COVID-19 Response under sections 11 and 15(1) of the COVID-19 Public Health Response Act 2020 in accordance with section 9 of that Act.

1 Title
This order is the COVID-19 Public Health Response (Required Testing and Vaccinations) Amendment Order (No 2) 2021.
2 Commencement
This order comes into force at 11.59 pm on 16 December 2021.
Part 1 Amendments to COVID-19 Public Health Response (Required Testing) Order 2020
3 Principal order
This Part amends the COVID-19 Public Health Response (Required Testing) Order 2020.
4 Clause 10 amended (Duty of relevant PCBU to facilitate compliance with testing and medical examination requirements)
Revoke clause 10(a)(ia).
5 Part 2 revoked
Revoke Part 2.
6 Clause 15 amended (Infringement offences)
In clause 15(1), replace “12D, 13, or 14”
with “or 12D”

Amendments to COVID-19 Public Health Response (Required Testing) Order 2020
Part 1 amends the COVID-19 Public Health Response (Required Testing) Order 2020 (the principal order) to make changes to provisions dealing with recurring saliva testing.
Clause 4 revokes clause 10(a)(ia) to remove a reference to saliva testing.
Clause 5 revokes Part 2, which specifies requirements in relation to recurring saliva testing.
Clause 6 consequentially amends clause 15(1) to adjust cross-references due to the requirements relating to recurring saliva testing being revoked.
Clause 7 consequentially amends several of the items in Schedule 2 of the principal order that relate to saliva testing.
Amendments to COVID-19 Public Health Response (Vaccinations) Order 2021
Part 2 amends the COVID-19 Public Health Response (Vaccinations) Order 2021 (the principal order) to make drafting changes.
Clause 9 amends clause 10(1AAA) to delete a redundant word.
Clause 10 makes a clarification to the Part 10 heading of Schedule 2 and replaces “of” with “at” in item 10.1 of Schedule 2 for consistency with item 10.4 of that schedule.
Approval by resolution required
This order must be approved by resolution of the House of Representatives before the expiry of the period described in section 16(2) of the COVID-19 Public Health Response Act 2020. If this does not happen, the order is revoked on the expiry of that period.

1 General
This is a consolidation of the COVID-19 Public Health Response (Required Testing and Vaccinations) Amendment Order (No 2) 2021 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
