This order is made by the Minister for COVID-19 Response under sections 11 and 15(1) of the COVID-19 Public Health Response Act 2020 in accordance with section 9 of that Act.

Order
1 Title
This order is the COVID-19 Public Health Response (Air Border and Isolation and Quarantine) Amendment Order (No 2) Amendment Order 2021.
2 Commencement
This order comes into force at 11.58 pm on 23 December 2021.
3 Principal order
4 Schedule 2 amended (New Part 4 inserted into Schedule 1 of Covid-19 Public Health Response (Isolation and Quarantine) Order 2020)
In Schedule 2, new Part 4, replace clause 11 with:
11 Persons undergoing period of isolation or quarantine under clause 10(1)(a) on commencement of Amendment Order
(1)
This clause applies to every person (a person with an existing duty)—
(a)
who immediately before 11.59 pm on 23 December 2021 has an existing duty to be isolated or quarantined in accordance with Part 1 of this order; and
(b)
to whom, immediately before 11.59 pm on 23 December 2021, clause 10(1)(a) of this order applies.
(2)
The requirements in Parts 1 and 1C of this order that applied to persons with an existing duty immediately before 11.59 pm on 23 December 2021 continue to apply to them.
(3)
In this Part, Amendment Order means the COVID-19 Public Health Response (Air Border and Isolation and Quarantine) Amendment Order (No 2) 2021.
11A Persons undergoing period of isolation or quarantine under clause 10(1)(aa) on commencement of Amendment Order
(1)
This clause applies to every person (a person with an existing duty arriving from a very high risk country)—
(a)
who immediately before 11.59 pm on 23 December 2021 has an existing duty to be isolated or quarantined in accordance with Part 1 of this order; and
(b)
to whom, immediately before 11.59 pm on 23 December 2021, clause 10(1)(aa) of this order applies.
(2)
The amendments to Part 1 of this order made by the Amendment Order apply to persons with an existing duty arriving from very high risk countries.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order amends the COVID-19 Public Health Response (Air Border and Isolation and Quarantine) Amendment Order (No 2) 2021 (the principal order), and comes into force at 11.58 pm on 23 December 2021.
This order replaces the transitional provisions that apply to people who, immediately before the principal order comes into force, have a duty to be isolated or quarantined in accordance with the principal order.
This order must be approved by a resolution of the House of Representatives before the end of the period described in section 16(2) of the COVID-19 Public Health Response Act 2020. If that does not happen, the order is revoked at the end of that period.

1 General
This is a consolidation of the COVID-19 Public Health Response (Air Border and Isolation and Quarantine) Amendment Order (No 2) Amendment Order 2021 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
