These regulations are administered by the Ministry of Justice.
These regulations are made under section 5 of the Prohibition of Gang Insignia in Government Premises Act 2013—
(a)
on the advice and with the consent of the Executive Counsel; and
(b)
on the recommendation of the Minister of Police made in accordance with section 5(2) of that Act.
Regulations
1 Title
These regulations are the Prohibition of Gang Insignia in Government Premises Amendment Regulations 2020.
2 Commencement
These regulations come into force on 24 April 2020.
3 Principal regulations
These regulations amend the Prohibition of Gang Insignia in Government Premises Regulations 2018 (the principal regulations).
4 Regulation 3 amended (New gang identified)
In the heading to regulation 3, replace “New gang”
with “Comanchero Motorcycle Club”
.
5 New regulation 4 inserted (Mongols Motorcycle Club identified)
After regulation 3, insert:
4 Mongols Motorcycle Club identified
The group of persons that is known by the name Mongols Motorcycle Club, or by a name that is substantially similar to that name, is identified as a gang for the purposes of the Prohibition of Gang Insignia in Government Premises Act 2013.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 24 April 2020, amend the Prohibition of Gang Insignia in Government Premises Regulations 2018 (the principal regulations).
The principal regulations identify a particular group of persons (the Comanchero Motorcycle Club) as a gang for the purposes of the Prohibition of Gang Insignia in Government Premises Act 2013 (the Act). This has the effect of prohibiting any person from displaying gang insignia relating to that gang in any government premises.
These regulations amend the principal regulations by inserting new regulation 4. The amendment means that, in addition to the Comanchero Motorcycle Club, the group of persons known by the name Mongols Motorcycle Club, or by a name substantially similar to that name, is identified as a gang for the purposes of the Act.

1 General
This is a consolidation of the Prohibition of Gang Insignia in Government Premises Amendment Regulations 2020 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
