These regulations are made under section 102(1)(h) of the Pae Ora (Healthy Futures) Act 2022 and section 437 of the Social Security Act 2018 on the advice and with the consent of the Executive Council.
Regulations
1 Title
These regulations are the Health Entitlement Cards Amendment Regulations (No 2) 2022.
2 Commencement
These regulations come into force on 10 October 2022.
3 Principal regulations
These regulations amend the Health Entitlement Cards Regulations 1993.
4 Regulation 2 amended (Interpretation)
In regulation 2(1), insert in its appropriate alphabetical order:
public transport service means a service for the carriage of passengers for hire or reward by means of—
(a)
a large passenger service vehicle (as defined in section 2(1) of the Land Transport Act 1998):
(b)
a small passenger service vehicle (as defined in section 2(1) of the Land Transport Act 1998):
(c)
a ferry:
(d)
a hovercraft:
(e)
a rail vehicle (as defined in section 4(1) of the Railways Act 2005):
(f)
any other mode of transport (other than air transport) that is available to the public generally
5 Regulation 12 amended (Authorised uses of community services cards)
After regulation 12(b), insert:
(ba)
to provide evidence to any of the following persons, for the purpose of receiving a discounted public transport fare (including validation of the fare and of the cardholder’s entitlement to the discount), that the cardholder has been issued with a community services card:
(i)
a person collecting fares for, or issuing tickets to, travel on a public transport service, including any ticketing agent; or
(ii)
a person operating a public transport service; or
(iii)
any person carrying out the work specified, and for a person specified, in subparagraph (i) or (ii):
6 Regulation 13 amended (Unauthorised uses of community services cards)
In regulation 13(3), after “regulation 12(b)”

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 10 October 2022, amend the Health Entitlement Cards Regulations 1993 (the principal regulations).
Regulation 4 amends regulation 2 of the principal regulations to insert a new definition of public transport service. This definition is based on the definition of that term in the Land Transport Management Act 2003 and means services that are offered in large passenger service vehicles, small passenger service vehicles, rail vehicles, hovercrafts, ferries, and any other form of transport (other than air transport) that is available to the public generally.
Regulation 5 amends regulation 12 of the principal regulations to allow a community services cardholder to show their community services card, for the purpose of receiving a discounted public transport fare, to a person collecting fares for travel on a public transport service, including a ticketing agent, a person operating a public transport service, or any person carrying out that work for those people.
Regulation 6 amends regulation 13 of the principal regulations. Regulation 13 of the principal regulations prohibits persons from asking or demanding to see a community services card except in very limited circumstances. The amendment extends those circumstances to allow the following people to demand or ask to see a community services card as evidence that the cardholder has been issued with that community services card:
a person collecting fares for, or issuing tickets to, travel on a public transport service, including a ticketing agent:
a person operating a public transport service:
any person carrying out that work for those people.
