Land Transport (Road User) Amendment Rule 2023
This ordinary rule is made by the Minister of Transport under sections 152, 153, and 157 of the Land Transport Act 1998,—
(a)
after having complied with the requirements of section 161(2) of that Act; and
(b)
after having had regard to the matters specified in section 164(2) of that Act.

Rule
1 Title
This rule is the Land Transport (Road User) Amendment Rule 2023.
2 Commencement
This rule comes into force on 1 October 2023.
3 Principal rule
This rule amends the Land Transport (Road User) Rule 2004.
4 Objective
A statement of the objective of this rule is set out in Schedule 1.
5 Consultation
A statement of the extent of any consultation carried out in relation to this rule under section 161(2) of the Land Transport Act 1998 is set out in Schedule 2.
6 Clause 1.6 amended (Interpretation)
In clause 1.6, insert in its appropriate alphabetical order:
clearway has the same meaning as in Part 2 of Land Transport Rule: Traffic Control Devices 2004
7 Clause 2.12 amended (Motorways)
In clause 2.12(2), replace “stop or park”
with “stop, stand, or park a vehicle”
.
8 Clause 6.4 amended (Parking contrary to notice, traffic sign, or marking)
(1)
Replace clause 6.4(1B) with:
(1B)
Without limiting subclause (1), a driver or person in charge of a vehicle must not stop, stand, or park the vehicle in any parking area reserved for the charging of electric vehicles unless—
(a)
the vehicle is an electric vehicle; and
(b)
the person is using the area for charging the vehicle.
(2)
After clause 6.4(1B), insert:
(1C)
Without limiting subclause (1), a driver or person in charge of a vehicle must not stop, stand, or park the vehicle in an area that is designated as a clearway or no stopping area.
9 Clause 6.19 amended (Parking trailers on roadway)
In clause 6.19(1), replace “7 days”
with “5 days”
.
Schedule 1 Objective of rule
This Land Transport (Road User) Amendment Rule 2023 (the amendment rule) amends the Land Transport (Road User) Rule 2004 (the principal rule). The principal rule establishes the rules under which traffic operates on roads.
The objective of the amendment rule is to—
(a)
clarify parking requirements in respect of motorways, electric vehicle charging areas, clearways, and no-stopping areas; and
(b)
reduce the number of days that a trailer may be parked on a roadway from 7 to 5 days.
Schedule 2 Consultation carried out under section 161(2) of Land Transport Act 1998
The Ministry of Transport (the Ministry) undertook consultation on behalf of the Minister of Transport on the Land Transport (Road User) Amendment Rule 2023 (the amendment rule) for a period of 5 weeks between 8 June 2023 and 13 July 2023.
The Ministry sent out notifications of the amendment proposals by email to a group of approximately 45 individuals as representatives of a road controlling authority.
Waka Kotahi New Zealand Transport Agency also sent out notifications of the amendment proposals by email to approximately 1,869 groups and individuals who had registered an interest in the rule. The draft amendment rule was made available, together with a consultation document, on the Ministry’s Internet site.
The Ministry received 2 submissions on the amendment rule. The submissions received were considered in finalising this amendment rule, following which it was submitted to the Associate Minister of Transport for signing.

This rule, which comes into force on 1 October 2023, amends the Land Transport (Road User) Rule 2004 to implement the objective described in Schedule 1.
