This order is made under section 217C of the Resource Management Act 1991—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister for the Environment made after—
(i)
satisfying the requirement of section 217C(3)(a) of that Act; and
(ii)
consulting the Minister of Agriculture.
Order
1 Title
This order is the Resource Management (Application of Part 9A—Freshwater Farm Plans: Southland) Order 2024.
2 Commencement
This order comes into force on 27 November 2024.
3 Interpretation
In this order, unless the context otherwise requires, Act means the Resource Management Act 1991.
4 Application of Part 9A of Act
Part 9A of the Act applies to the Southland region.

Explanatory note
This note is not part of the order but is intended to indicate its general effect.
This order, which comes into force on 27 November 2024, specifies that the Southland region is a region to which Part 9A of the Resource Management Act 1991 (the Act) applies. Part 9A of the Act sets out obligations for the preparation, certification, and audit of freshwater farm plans.
In the Southland region, the Southland Water and Land Plan has regional farm planning requirements to manage the impacts of farming activities on the environment. To meet those regional requirements, farmers could prepare a regional farm plan or follow the Part 9A freshwater farm plan system.
The Resource Management (Freshwater and Other Matters) Amendment Act 2024 paused the use of freshwater farm plans under Part 9A by revoking the previous Part 9A application order.
This order enables farmers in the Southland region to resume the development of freshwater farm plans to meet regional farm planning requirements.

The Ministry for the Environment produced a regulatory impact statement on 30 October 2024 to help inform the decisions taken by the Government relating to the contents of this instrument.
