This order is made under section 115 of the Health Practitioners Competence Assurance Act 2003—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Health made in accordance with section 115(3) of that Act.
Order
1 Title
This order is the Health Practitioners Competence Assurance (Designation of Chinese Medicine Services as Health Profession) Order 2021.
2 Commencement
This order comes into force on 1 November 2021.
3 Chinese medicine services designated as health profession
Chinese medicine services are designated as a health profession.
4 Establishment of Chinese Medicine Council of New Zealand
The Chinese Medicine Council of New Zealand is established as the authority appointed in respect of the Chinese medicine health profession.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on 1 November 2021, is made under section 115 of the Health Practitioners Competence Assurance Act 2003 (the Act).
This order—
designates Chinese medicine services as a health profession; and
establishes the Chinese Medicine Council of New Zealand (the CMCNZ) as the authority appointed to regulate the Chinese medicine health profession.
The effect of this order is that, from 1 November 2021,—
the Minister of Health may appoint the members of the CMCNZ:
the CMCNZ will set 1 or more scopes of practice for the Chinese medicine profession:
the CMCNZ will have the status and functions set out in sections 117 to 119 of the Act.
