This order is made under section 60 of the Climate Change Response Act 2002—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Climate Change made after complying with the requirements of sections 3A, 3B, and 60 of that Act.
Order
1 Title
This order is the Climate Change (Waitaki District Council) Exemption Order 2025.
2 Commencement
This order comes into force on 16 May 2025.
3 Interpretation
In this order, unless the context otherwise requires,—
Act means the Climate Change Response Act 2002
activity means the activity of operating a disposal facility
Council means the Waitaki District Council
historic waste means the 19,839 tonnes of waste that had previously been located at 2 unofficial landfill sites located on the coastal side of Beach Road, near its intersection with Awamoa Road, in Awamoa, Waitaki District, Otago
Palmerston landfill means the landfill contained within Part Section 12, Block II, Hawksbury Survey District.
4 Exemption
The Council is exempt from being a participant under Part 6 of Schedule 3 of the Act in respect of the part of the activity involving the disposal of historic waste at the Palmerston landfill in 2024.

Explanatory note
This note is not part of the order but is intended to indicate its general effect.
This order, which comes into force on 16 May 2025, grants the Waitaki District Council (the Council) an exemption from being a participant as a person operating a disposal facility under the Climate Change Response Act 2002 in relation to specific historic waste.
The Council is exempt in relation to historic waste that was—
previously located at unofficial landfill sites in Awamoa, Waitaki District, Otago; and
disposed of at the Palmerston landfill in 2024.
