Clause 39
Delete clause 39 (page 32, lines 11 to 20).
Explanatory note
This Supplementary Order Paper amends the Employment Relations Amendment Bill by deleting clause 39 of the Bill.
The clause as it stands provides that the primary remedy in respect of a personal grievance is weighted towards reinstatement. The impact of this will vary across places of employment. However, it remains that, in some instances, there may be reservations about a returning employee and their effect on others in the workplace, and therefore it would not be appropriate that the primary remedy in respect of a personal grievance is to be reinstatement to the place of employment.
