Proposed amendments
Simon Court, in Committee, to move the following amendments:
Clause 4
In clause 4(1), in the definition of appointed member,—
(a)
replace “a member”
(page 2, line 19) with “a non-voting member”
:
(b)
after “under section 7”
(page 2, line 20), insert “to advise on matters that TRoNT has expertise in”
.
Clause 6
Replace clause 6(7) (page 4, lines 23 to 25) with:
(7)
Members appointed under this Act—
(a)
do not have any voting rights on the Council; and
(b)
are appointed solely to provide advice to the Council on matters that Council identifies that TRoNT has expertise in, such as resource management issues or issues where cultural input will be valuable.
Clause 7
Replace clause 7(3) (page 5, lines 4 and 5) with:
(3)
Every member appointed under this section—
(a)
must be qualified to be elected as an elected member at the date of appointment; and
(b)
must meet 1 or more of the following criteria:
(i)
they are a director of TRoNT:
(ii)
they have suitable governance experience in the private sector, in local government, or in both.
Explanatory note
This Supplementary Order Paper amends the Canterbury Regional Council (Ngāi Tahu Representation) Bill. It would ensure that the appointed members from Te Rūnanga o Ngāi Tahu (TRoNT) are only able to advise the Council on matters relating to resource management issues. It means that Council decisions remain in the hands of democratically elected Councillors, and that non-elected members can only advise on area relating to their interests—not on matters such as the setting of rates (where the principle of “no taxation without representation” is paramount). It also clarifies that the non-voting members must be either directors of TRoNT or have relevant governance experience.
