Proposed amendment
Erica Stanford, in Committee, to move the following amendment:
Clause 5B
In clause 5B, after new section 17C (page 11, after line 2) insert:
17CA Transfer of licence when premises acquired by Crown
(1)
This section applies to any licensed early childhood service the premises of which are:
(a)
acquired by the Crown under Part 2 of the Public Works Act 1981; or
(b)
subject to notice of desire to acquire land under section 18(1) of the Public Works Act 1981; or
(c)
subject to notice of intention to take land under section 23 of the Public Works Act 1981.
(2)
The operator of any licensed early childhood service to which subsection (1) applies may relocate their service, acquire another service, or establish a new service, and have their licence transferred to that service by notifying the Ministry of their intention to transfer.
(3)
Any early childhood service to which an operator wishes to transfer their licence under subsection (2) must be located within 10 kilometres of the operator’s original service to which subsection (1) applies.
Explanatory note
This Supplementary Order Paper would amend the Education and Training Amendment Bill (No 2) to allow early childhood service operators whose premises are acquired under the Public Works Act 1981 to transfer their service to another nearby location without applying for a new licence.
