Proposed amendments

Clause 11
In clause 11(3)(b), replace “.”
(page 9, line 12) with “; or”

In clause 11(3), after paragraph (b) (page 9, after line 12), insert:
(c)
at least 1 insurer or the EQC remains and at least 1 third party respondent remains as a respondent.
Explanatory note
This Supplementary Order Paper amends clause 11 of the Canterbury Earthquakes Insurance Tribunal Bill. Currently, once settlement is reached between the EQC or an insurer and the policy holder, the insurers or EQC will need to reapply in the High Court if they wish to pursue a claim against a third party that had been involved in proceedings. This SOP will allow insurers and EQC to continue claims against third parties via the Tribunal to avoid the slow and costly process of going through the High Court.
