Darien Fenton, in Committee, to move the following amendments:
Clause 12
In clause 12, new section 317E(1)(a) (line 36 on page 11), delete “all or”

In clause 12, new section 317E(2)(b) (line 10 on page 12), replace “modifications.”
with “modifications; and”
.
In clause 12, new section 317E(2) after paragraph (b) (after line 10 on page 12), insert:
“(c) relate to a specified individual.
Explanatory note
This Supplementary Order Paper amends clause 12 of the Immigration Amendment Bill. The amendments to new section 317E requiring individual assessment would ensure New Zealand meets its obligations to use detention only where necessary. The provision would continue to provide a mechanism to hold particular individuals further for reasons of continuing health, security, or identity concerns, while allowing others who arrived as part of the group, who do not pose such concerns, including women and children, to be considered for alternative options to detention while their claims for asylum are assessed.
