Clause 16: new section 71
In clause 16, delete new section 71(5) (page 15, lines 21 to 26).
Clause 70
Delete clause 70(1) (page 47, line 34 to page 49, line 6).
Explanatory note
This Amendment Paper amends the Resource Management (Consenting and Other System Changes) Amendment Bill to delete new section 71(5) and clause 70(1), new clause 4B in Schedule 1. The purpose of this amendment is to oppose the restriction of the notification rules that control fishing in a regional coastal plan unless the Director-General of the Ministry for Primary Industries concurs with the assessment under section 32(2A). The new requirement for the Director-General to concur with the assessment is unnecessary. If there is a difference in expert opinion between the experts at the Ministry for Primary Industries and an expert engaged by a regional council, that should be tested through a hearings process not an internal Ministry process. In addition, clause 3 of Schedule 1 in the Resource Management Act 1991 already includes a requirement to consult the Minister of Fisheries in relation to fisheries management prior to the notification of a regional coastal plan.
