Proposed amendments
Ricardo Menéndez March, in Committee, to move the following amendments:
New clause 194A
After clause 194 (page 126, after line 12), insert:
194A Advertising prescription medicines to public prohibited
(1)
A person in New Zealand must not distribute an advertisement for a prescription medicine other than to a recognised prescriber.
(2)
This section overrides any other provision of this Act.
Clause 253
Replace the heading to clause 253 (page 153, line 14) with “Offences”
.
After clause 253(1) (page 153, after line 25), insert:
(1A)
A person commits an offence if they knowingly or recklessly contravene section 194A.
Explanatory note
This Supplementary Order Paper amends the Therapeutic Products Bill to prohibit direct-to-consumer marketing of prescription medicines.
