Schedule
In the Schedule, replace clause 1.1.17 of the trust deed (page 7, lines 39 to 41) with:
1.1.17
A reference to “children” is a reference to children and young persons under the age of 18 years old.
Explanatory note
This Amendment Paper amends the McLean Institute (Trust Variation) Bill.
The inclusion of references to gender in the revised trust deed’s definition of children contradict the principles of equality. Such language undermines equality and perpetuates outdated stereotypes that have no place in modern legislative frameworks.
Additionally, the phrase “and is otherwise to be interpreted in its broadest possible sense” is concerning due to its vagueness, which could lead to misinterpretation and potential bias. To address these issues, the definition should be revised as stated in the amended version.
This revision removes gender specification, ensuring inclusivity, and upholding the principles of equality and fairness.
