Proposed amendments

Clause 4: new section 65S
In clause 4, new section 65S(1)(a)(i), after “costs of”

In clause 4, after new section 65S(1) (page 15, after line 17), insert:

Subsection (2A) applies in relation to revenue from a time of use charging scheme to be disbursed by the Agency under subsection (1)(a)(i), (ii) or (iv) to meet any costs of an activity for which payments from the national land transport fund have been approved under section 20.
(2A)
Any revenue to which this subsection applies must be paid by the Agency into a Crown Bank Account and treated as land transport revenue for the purposes of this Act.

details of any billing system developed for the purposes of subsection (1)(a); and
(b)
details of any technical specifications relating to data and security set by the Agency under section 65ZGA.
Clause 4: new section 65ZGA
In clause 4, after new section 65ZG (page 26, after line 33), insert:
65ZGA Agency may set technical specifications relating to data and security
The Agency may set technical specifications relating to data and security for the interaction of a time of use charging scheme with the Agency’s systems for billing and collecting time of use charges.
Explanatory note
This Amendment Paper amends the Land Transport Management (Time of Use Charging) Amendment Bill (the Bill) to provide, in new section 65ZGA, that the Agency may set technical specifications relating to data and security for the interaction of time of use charging schemes with the Agency’s systems for billing and collecting time of use charges. The Amendment Paper amends new section 65W to require a scheme board to monitor the compliance of a time of use charging scheme with those technical specifications relating to data and security and new section 65ZG(2) to require the Agency to make details of those specifications available, free of charge, on its internet site.
Separately, this Amendment Paper amends the Bill to—
clarify, for the purposes of new section 65S, that establishment costs include any costs relating to the establishment of a scheme board under new section 65U(2):
clarify, in new section 65S, that revenue from a time of use charging scheme can be used to repay certain costs of that scheme paid from the national land transport fund provided that those costs have been approved as an activity in a national land transport programme under section 20 of the principal Act:
provide, in new section 65UB, that the Agency must reach agreement with the local authority members of the scheme on any proportion of establishment costs to be incurred by the Agency under new section 65D.
This Amendment Paper also makes 2 technical amendments to the Bill to—
clarify, in new section 65U, that a scheme board is not responsible for directing the enforcement of a time of use charging scheme, as enforcement is the responsibility of the scheme’s enforcement authorities; and
correct a minor error in new section 65X(3)(a).
