These regulations are made under section 13C(1) of the Contraception, Sterilisation, and Abortion Act 1977—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Health after consultation with the Minister of Justice and after being satisfied of the matters in section 13C(2) of that Act.
Regulations
1 Title
These regulations are the Contraception, Sterilisation, and Abortion (Safe Areas) Amendment Regulations 2023.
2 Commencement
These regulations come into force on 5 October 2023.
3 Principal regulations
These regulations amend the Contraception, Sterilisation, and Abortion (Safe Areas) Regulations 2023.
4 Regulation 4 amended (Safe areas)
(1)
After regulation 4(b), insert:
(ba)
the area described in clause 2A of the Schedule, being—
(i)
the premises of Thames Hospital; and
(ii)
an area around those premises; and
(bb)
the area described in clause 2B of the Schedule, being—
(i)
the premises of Te Aka Tauawhi Tangata—Women’s Clinic (Rotorua Hospital); and
(ii)
an area around those premises; and
(bc)
the area described in clause 2C of the Schedule, being—
(i)
the premises of the Terrace Clinic (Hawke’s Bay Hospital); and
(ii)
an area around those premises; and
(bd)
the area described in clause 2D of the Schedule, being—
(i)
the premises of the Women’s Clinic, Palmerston North; and
(ii)
an area around those premises; and
(2)
After regulation 4(f), insert:
(g)
the area described in clause 7 of the Schedule, being—
(i)
the premises of the Women’s Clinic, Invercargill; and
(ii)
an area around those premises.

2A Description of Thames Hospital safe area
The Thames Hospital safe area is the area enclosed by a line that—
(a)
commences at 130 Bella Street (at 37°8.128′S, 175°32.575′E); then
(b)
proceeds in a generally easterly direction along the northern side of Bella Street to the end of Bella Street (at 37°8.086′S, 175°32.687′E); then
(c)
proceeds in a south-easterly direction to 100 Redwood Lane (at 37°8.109′S, 175°32.723′E); then
(d)
proceeds in a south-easterly direction to the intersection of Redwood Lane and Karaka Road (at 37°8.129′S, 175°32.750′E); then
(e)
proceeds in a generally south-westerly direction along the south-eastern side of Karaka Road to the intersection of Karaka Road and Rolleston Street (at 37°8.263′S, 175°32.719′E); then
(f)
proceeds in a westerly direction to 819 Rolleston Street (at 37°8.263′S, 175°32.701′E); then
(g)
proceeds in a north-westerly direction to where Rolleston Street becomes Mary Street (at 37°8.237′S, 175°32.675′E); then
(h)
proceeds in a south-westerly direction to the intersection of Mary Street and Mackay Street (at 37°8.260′S, 175°32.593′E); then
(i)

proceeds in a south-westerly direction to Service Lane 5 (at 37°8.298′S, 175°32.565′E); then

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 5 October 2023, amend the Contraception, Sterilisation, and Abortion (Safe Areas) Regulations 2023.
The amendments prescribe 5 additional safe areas for the purposes of sections 13A to 13C of the Contraception, Sterilisation, and Abortion Act 1977. The safe areas are at the following premises:
Thames Hospital:
Te Aka Tauawhi Tangata—Women’s Clinic (Rotorua Hospital):
Terrace Clinic (Hawke’s Bay Hospital):
Women’s Clinic, Palmerston North:
