This order is made under section 148 of the Local Electoral Act 2001 on the advice and with the consent of the Executive Council.
Order
1 Title
This order is the Local Electoral (Tauranga City Council Te Awanui Māori Ward Election) Validation Order 2025.
2 Commencement
This order comes into force on 1 April 2025.
3 Revocation of this order
This order is revoked on 31 December 2025.
4 Interpretation
In this order, Act means the Local Electoral Act 2001.
5 Conduct of election
(1)
This clause applies to the election—
(a)
conducted to fill an extraordinary vacancy in the Te Awanui Māori ward of the Tauranga City Council; and
(b)
that was publicly notified, under section 52 of the Act, on 3 February 2025.

The election may be conducted in accordance with the Act and any regulations made under the Act as they appeared at the close of 31 March 2025.

Explanatory note
This note is not part of the order but is intended to indicate its general effect.
This order, which comes into force on 1 April 2025, is made under the Local Electoral Act 2001 (the Act). The Act sets out the requirements for a by-election when an elected member position becomes vacant.
The Local Government (Electoral Legislation and Māori Wards and Māori Constituencies) Amendment Act 2024 (the amendment Act) amends the Act from 1 April 2025, changing the requirements for such a by-election. However, the amendment Act does not include transitional arrangements for a by-election that has started, but has not been completed, before the new requirements come into force.
As the result of an elected member resigning, a by-election is required for the Te Awanui Māori ward of the Tauranga City Council. This by-election has commenced, but will not be completed before 1 April 2025, when the new requirements come into force. This order provides that the entire election may be conducted under the Act and any regulations made under the Act as they appeared on 31 March 2025, before the new requirements come into force.
The order is revoked on 31 December 2025.
